I believe the matter is a bit simpler. Human rights are maid by human for humans. humans made anima rights because hurting animals heart humans as humans see the animals partially humans (this is a luxury we can afford). The robot right could appear in two cases : the robots could destroy humans or we will see them partially human as we did with animals.
The rights are just rules of the human society.
