@w_iii_s_p Fan art is not often made for the intent of selling for profit. Or to undermine the employment of the original creator. If you steal a painting, it doesn't mater if you stole it to practice your own artistic skills. You still stole the painting. End of story. That is what is being argued. That these generative slop scams stole the material that they trained their software on, that is now being used to generate billions, if not trillions, of images and stories. It really isn't a complicated situation. 😒 How the software works, is irrelevant. How 'transformative' the results might be, is irrelevant. Copilot gave me a word-for-word reprint of someone's OC bio over on Toyhouse. (And yes, I checked. Every word of the character bio except the name, was the same.) What maters is if they legally obtained the data they used. And given the fact that most people were not even aware their images/stories were being scraped? And the fact that they quickly started offering paid services? Chances are a bulk of their training data was obtained illegally.
