I don't know about the therapy part, but ChatGPT's service agreement does allow OpenAI to use chat sessions for training (the service agreement for the *API* does not - but a chat bot made using it still could, depending on its own terms), and GPT and other LLMs can output chunks of its training data verbatim.
An LLM you're running locally wouldn't have the same concern though.
