I think the weak point in the issue is the _implied premise_ that 'intellectual property' is a legitimate concept. In my view, it isn't a legitimate concept. (Yes, I know, law & culture disagree but so what? Appealing to numbers/popularity is a fallacy). As you mentioned in the short, humans are trained, in part, by looking at and learning from prior artist's works. The degree of emulation and/or inspiration is incalculable except for the present construct that says lawyers and judges can, in fact, draw such definite lines in an otherwise foggy space. So, no, I don't think A.I. art infringes on any of the artists whose works it has considered during training. I think A.I. art is the same sort of thing that occurs with human artists-in-training. Granted, the speed with which A.I. produces works is much greater than humans can achieve, but this is true across many, perhaps most, of the industries where A.I. is being trained and/or 'employed'. A.I. is here to stay. Either we're going to adapt or we aren't. Those who adapt will lead the way for others to follow, and those who refuse to adapt... will be left behind with little more than sour grapes to offer.
