I imagine this going in the same way as the case as the chimp taking a picture with a photographer’s camera. The chimp can’t legally hold copyright of the photo and since the photographer didn’t take the photo she didn’t own the copyright so it was in the public domain. The case is Naruto V. Slater if anyone is interested. Although I do imagine that since a person who originally created it has copyright, the person who uses a AI generated art tool to generate art might be held liable if it isn’t in the public domain. Otherwise the counter point is it a new work of art and has its own copyright. We see this is the music industry all the time.
