People know nothing about legality and definitions of terms. If AI is accused of stealing anything, it is "stealing" a style. More accurate put, it is interpreting a set of algorithmic relationships within a set of works and applying it to a random bit of noise. Each iteration of denoising does not copy in whole or in part anything from original works.
A license fee for usage can not be charged if the submitted work is free access to the public and displayed with that agreement in mind.
The charge of "for profit" is not applicable, the dataset is as free to use as the original work is to be viewed. The only charge applied is for the usage of their computing services. You can, if you choose to, set up your own rendering system with all datasets available for free.
