The LIDAR definitely see the pedestrian, the pedestrian is moving towards the cars way so that AI or system should predict this and slows it down or the car should stop/lean to right just like when a TESLA car is doing when an object is too close to its sides. There's definitely wrong to its system and the data will provide that when they investigate and at the end the system/UBER will be blamed on this.
