I raised the alarm about this back before it exploded, but have no following, so went unheard. Hopefully more people will see this. I think you are mostly accurate on all of your points, and this is very important because there's a gross misunderstanding within the artist community about how AI works, and the expectations they should have around dealing with it. I would suggest that you look at how it has been handled internationally from a legal standpoint, as that is definitely going to affect how it is addressed, if it is addressed, from a legal standpoint nationally. Being pragmatic, I think probably the best we're going to be able to hope for is a "legal for a fee" approach from regulators. Which is to say, they might be charged a hefty penalty. But that will not compensate the artist nor eliminate what stable diffusion and others are doing. Speaking from a very seasoned position as a game developer I can tell you that unfortunately this is the future. I personally know large and small studios that are already doing experiments to see how they can integrate this into their development process. With their eye also on the development of text/image to video and text/image to 3d technology. AI driven animation. For them at the end of the day it comes down to market advantage. The technology definitely offers financial savings and will only improve in the future. And to remain competitive they're going to adopt this when and how they are able. Unfortunately, appealing to the empathy of anyone on the other side of this argument is going to be a waste of time. I've had these debates with producers designers and engineers, and to my surprise, I think they have no context for relating to the situation artist is in. They can't imagine putting the amount of years of effort into developing a very specific skill set and then having the product of that skill set stolen. I think it comes down to Art being a concrete discreet byproduct of the effort. Producers work is intangible at best. A designer's work is similarly amorphous from a game design standpoint. And a writer's work uses the same Lego blocks (words) but every other writer uses. They don't invent words along the way. Maybe I'm giving them the benefit of the doubt and they just don't care because it's not happening to them.
