If you sued the company and had reasonable grounds to suspect they had scraped your content and used it to train a model, you could potentially get discovery of their records that would confirm your suspicions. For NYT they were able to get GPT to produce full articles pretty much verbatim, so if you could do the same with an LLM that trained on your material you might have a case. The difference though is that there was already plenty of evidence even prior to discovery that OpenAI used NYT journalism to train its models. Back when OpenAI was actually open and disclosed their training data.
