In Europe, these would be 2 different court cases. The road accident would be 100% the driver's fault, and imo it is. Self driving cars might be the future but are being tested in the US for a reason.
But it is obvious that Tesla is overselling and overhyping, advertising something their cars do not live up to. That's fraud.
