Just because a company does something doesn't automatically make it legal.
Facebook (or rather Meta) was just given the largest fine in history for doing what you're talking about.
And they're banned from doing it now.
AI can be trained on open source data.
There's no reason why artists should just accept that their work is being used without proper compensation, like you suggest.
