The presence of another human being is what differentiates the two. It's the same as with the microwave meal analogy - another human actually did the choices of assembling the frozen meal. If there are pathogens in it or shards of glass, the person who microwaved it is not considered to be responsible.
But AI art is wholy on the person using the AI tools, so if they produce something illicit they are held responsible.
Among generative art, which has existed in some form for decades, AI art tools are only unique in that they are aimed at producing representative art. Other forms of generative art prior to it, such as fractal art tools, pendulum painting or pour painting, were difficult if not impossible to use for anything besides abstracts.
