I've heard from a couple people in the Machine Learning/AI space, one of them being the head dev for Midjourney, say they can still get similar results WITHOUT using the copyrighted artworks. This would be an amazing step towards an ethical model, and alleviate many artists' concerns, yet they don't want to make a dataset without it. At least when it comes to visual art.
Also, there are many skilled artists who are happy to add their work to the dataset. I've seen them talk about it.
