That's already the case, at least in the US. Any work without an identifiable human author is automatically in the public domain. This has been discussed a lot in the stable diffusion subreddit, and it seems the most common opinion there is that raw generations should be public domain, but there's disagreements about digital art made mostly with AI generated assets.
