I don’t think there’s much argument over your scenario, they are pretty clearly infringements
What’s debated here is, if you reproduce an article with non-commercial open-access, verbatim and on demand, is this a copyright infringement?
This might have very different answers for human vs AI. This is generally fair use for humans; but because AI itself is a commercial product, if the juries does not find this to be fair use then it is in violation of the non-commercial clause.
Hence why this needs a trial
