If we apply the same reasoning to dreams as we do to generative art, then we should not allow dreams to be copyright protected. The whole issue from the copyright office's perspective is that the work created was done so consciously, as well as mechanically (using one's own hands) to a fair degree. Dreams are unconscious manifestations, and so I don't think they would meet these criteria.
It's just occurred to me, however, that an interesting discussion could very possibly take place in this regard sometime in the near future. Even before the machine learning and generative ai boom, technology was being developed which proved it could - somewhat crudely - "draw" an image being looked at by a person at a different location. The person would sit and stare at an image while wearing a very scifi looking skull sock which was packed full of electrodes to monitor their brain activity. Their brain signals were interpreted by a computer program, and the image the person was looking at could be successfully replicated. I remember seeing something about Dall-E2, I think it was, being incorporated into that technology, which delivered much better representations of the image being remotely viewed.
Anyway, as I'm sure you're well aware, these technologies have begun to move forward at a great pace. Perhaps not too long from now we'll be able to replicate whatever images we hold in our imaginations. Wouldn't that be neat! Generative video is coming along pretty quickly too; maybe sooner than later, we'll be able to record and play back our dreams. I've actually longed for this since I was young. That's because my whole life I've had wildly vivid and epically fucking awesome dreams from time to time. If I could sell tickets to showings of my dreams - ooh! on the big screen even! - I swear to god I'd be making money hand over fist.
Would any of that be possible i.e. making money from content originating from our unconscious mind? It would only happen through the technology, so, it would necessarily be generated by ai. Could this content be copyright protected? I think it's interesting to think about. What about you?..
