While OpenAI is explicitly doing criminaly illegal things. You unfortunately can't sue because you can't prove any damage was done.
Yeah, their webcrawler scraped your image. But that's no different than a usual user saving it.
But you can't prove they illegally used that specific image in the training of their AI model. Which is the problem.
