Excellent question, and there are 2 parts to the reply.
1. Voluntary use of facial recognition as a form of ID may be voluntary but it it screws up, you got a problem
2. Involuntary use, e.g. cops on the street, is usually justified by the idea that you voluntarily went on the street and showed your face. Crazy I know.
