What you described is called outliers detection, which when it sees something not similar to its training data, it will respond distinctly like slowing down by emergency braking, etc. It's already in advanced algorithms like FSD. The accident in this video was 2021 and still using autopilot which is way inferior to FSD.
Now to your suggestion, hardcoded rules and policies are effective to handle corner and edge cases when the algorithm is not sophisticated. While not necessary if the algorithm gets better and more effective
