You're just shifting who builds the models and asking insurance companies to be the ones building the black boxes. Yes, insurance companies do have people who build black box algorithms too, but they will basically do the same thing.
Actually your plan has a massive flaw: insurance premiums don't only include measures of risk, but also multiple other business considerations. They want to sell more policies after all! So now you would have the justice system being partially influenced by some massive insurance company's 5 year growth plan. Not a great idea.
