You have some good points, but the copyright law, as written, doesn't work like this. To be considered a copyright infringement you need to do some very specific things: perform, public display, distribution, copying, impersonation and making into a derivative work are considered copying infringement. The problem we have is that AI doesn't do nothing of it. AI identifies patterns in information and creates new material it could recognize as trained before. Which means that the results of it don't have a direct relationship with the final results. As is impossible to compare an AI model with any specific piece of art (yes, it needs to be comparable with specific pieces of art individually), AI trying could not be classified as a copyright infringement.
Of course using AI to create a derivative work is a copyright infringement, but that responsibility falls on the final user.
