You used "Whataboutism": the technique or practice of responding to an accusation or difficult question by making a counteraccusation or raising a different issue.
He's not saying that it isn't possible to make AI that doesn't use copyrighted content, what he's saying is that it's impossible to make AI that doesn't use copyrighted content AND function at the same level it currently does. Reading comprehension and nuance goes a long way. Try as you might, AI without the hundred or so years of animation and art from big studios isn't at nearly the same level as what it would be without those things.
