Exactly my thoughts. He/she definitely bares responsibility of being in control of the car, fully autonomous or not so justice will be served in that respect. HOWEVER, walking in the dark crossing an unlit street where there doesn’t appear to be even a crossing (at the very least), in dark clothing with an oncoming car doing almost 50MPH? That wasn’t going to end well, whether he/she was paying attention or not. You can’t see her until a second before impact, oh she was going to get hit either way. If he/she wasn’t so stupid to be depending on the car and paying attention he/she would be a free person now. Pedestrians are sooo stupid and unfortunately so was this driver.
