If all of the participating vehicles are self-driving that would in theory work but it doesn't solve the underlying problem. I mean of course that would be something we would want to implement since it's minimizing danger to humans but the scenario is a hypothetical so even if you can avoid this specific scenario you could always find scenarios where you're back to making this kind of difficult decision which is why its a problem that needs to be solved
