People write the algorithm for the general case. The algorithm they use for this could be the same algorithm used by YouTube to recommend videos. The algorithm itself wasn't developed specifically for this case.
The data used to train the algorithm is data that came from previous cases of whether someone was arrested again.
The only true bias the algorithm could have is overfitting.
