It was not just the facial recognition hit that landed him in jail. His photo from that hit (probably a booking photo from a previous arrest) was shown to a witness who identified him as the offender. Ideally, the police should have interviewed him and given him a chance to account for his whereabouts at the time in question and then investigated his story before they decided whether to arrest him. Nonetheless, they had probable cause (which is a pretty low standard) to arrest him based on the photo line-up ID alone. This sort of thing happens a lot even when there is no photo recognition software involved. The photos do look very much alike. Because the mistake was not intentional the cops, prosecutor, and judge can probably successfully defend based on sovereign immunity. Sorry Bro.
