Federal courts, both lower and appellate, have consistently opined that a copyright is “the exclusive right of a man to the production of his own genius or intellect.” If work is autonomously generated, whether by AI or a programmatic algorithm, then it is not eligible for copyright, patent, or any other form of legal protection.
The lack of legal protection for AI generated works does not only affect authors and artists, but also software developers, architects and engineers, and even businesses which allow office workers to use generative AI in their work product.
It is the legal lack of ownership in AI generated works which will ultimately prevent the creators of AI from ever realizing great wealth for the investors in this technology.
