I don't see how a neural network trained on copyrighted work can be anything other than a derived work, if we're being consistent about the way that's applied elsewhere. I don't see how the same argument wouldn't apply to a JPEG or MP3 of a copyrighted work. (More so JPEG). It's substantially transformed from the original, in a lossy fashion. Sure, figuring out how a neural network reproduces a picture of Spiderman, happens to be a lot more difficult than doing so for a human designed algorithm like JPEG, but I don't see how that's relevant. The only other counterarguments I see commonly are based around anthropomorphising AI like "oh so it's copyright infringement to be influenced by other peoples' paintings". AI is not a human being, it is not sentient, it does not get "influenced" by anything.
