The legal argument is that it’s derivative by the very nature of the technology. It is different from being inspired because it’s a bunch of reference images layered and filtered with noise. The ai doesn’t “draw” art based off prompts, it takes images associated with the words you type and layers them many, many times. This is copyright infringement by its very nature.
