Godel proves the opposite of Penrose's argument: The point of Godel is that any non-trivial logical system is incomplete as follows : You have some system in front of you, To fully describe the system, you need a model of the system. In order to fully describe the model of the system, you need a model of your model of the system. In order to full describe the model of the model of the system, you need a model of the model of the model of the system, so on and so forth in infinitum.
Therefor, if you have some set of rules, you can not determine that the system that is following those rules, won't follow some other rules, since you don't have a complete model of that system. That's why the question : "Can the AI just make up its own rules?" is a valid question, and essentially a correct statement.
Logical systems do exactly this in fact. Emergence is the phenomenon that some system is following some set of rules, then all of a sudden (by transformation) we see new behavior emerge from that system of rules...typically its through scale but it can be any transformation.
