That's why the AI, Running on top of the dataset should be dynamic enough to only allow referencing artists and named pieces of art that are currently within the public domain. It needs to be able to dynamically keep itself up to date in this regard as well.
Secondly, people working with generative AI should rather specify the aesthetics of the piece they wish to produce and stop referencing artists directly that are not currently within the public domain.
Thirdly also the people who generate these pieces need to discipline themselves to write far longer and detailed prompts to pin down the generated piece that they desire. This is no longer a case of generating 20 pieces in 20 minutes and flooding the market with them. The onus should be that the generation of AI based material should be part of one's workflow and should be an iterative process (using methodologies such as inpainting and outpainting) that progressively removes artifacting, adds to image coherence and still undergoes modification and post-proccessing to create a better and more finished product than just being lazy and let everything be done for you.
