If the deepfakes arent shared, I cant see the calculable damages to the victim. Say some guy draws a lifelike lewd drawing of person he sees in public but never shares it. Without the exposure to the public of the image you don't have the damage. We dont need to be going into peoples computers further upsetting privacy for something that hasnt been shared. It's the same principal with child porn, possesion is illegal sharing can get you a life sentance. I think if we criminalize the sharing of deepfakes without consent than we can have traceable data by which to punish the uploader and hold thag party accountable for future damages if it keeps getting shared. We could criminalize possesion, but im not certain the damage if it's not uploaded to a public forum to a victim, especially if the victim never has knowledge of the deepfake, it's just really hard to het causation under the law for the damages, or damages at that if the vicitim is never aware of the creation of the image.
