the driver is always responsible because autopilot/FSD are not autonomous, as in not level 3+. it's just a very advanced level 2 system that you still can't trust at anytime or in any conditions, and even less trustable at night or in heavy weather conditions. Tesla autopilot/fsd terms and conditions are very clear about it:

While these features are designed to become more capable over time, the currently enabled features do not make the vehicle autonomous.
anything suggesting otherwise is just disinformation, whether it's coming from Elon musk, or other influencers. there's clearly a conflict of interest when Elon musk tweets about self driving and can make very wild claims, being #4 most followed influencer and still taking zero responsibility in the consequences, while being also Ceo and founder of the company
