We are in a surveillance state by the reality that we are collecting information about everyone all the time. We just haven't used it except in very rare situations although its deemed necessary for Homeland Security. The key for the surveillance state is to never reveal the extent to which surveillance is being done and handing it over to AI is probably just around the corner.
