If the facial recognition software misidentified anyone, we would say the software is flawed and needs improvement. If it however misidentified black people at a relatively more frequency than it does with white man, we will say this is clear evidence of bias and that the software is not only flawed but also prejudiced against black people. There may not have been intent for it to end up working like that but if developers, cities & police who hire or pay towards flawed products like this are not penalized for it, this will simply never change.
