fair use allows individuals to be "trained" using their brain, to consume copyrighted work and produce original derivitive work, such as fan art.
this is acceptable. similarly, if a person becomes knowlegable about a topic they read about and begins speaking upon the subject...that is fair use. you trained your brain by consuming it, then used that knowledge to produce derivitive thought.
what is not protected is whole reproduction.
but tricking an AI into reproducing a work makes the user culpable of infringement, not the machine, because if it can be shown....its operating in good faith.
