A few months later and there has been AI generators created using exclusively public domain art with nearly the same results. Using copyrighted material was never the right angle anyway. The AI is not profiting from copyrighted material, it it is feeding it into a blender and profiting from what comes out the other side. Just like all artists do to learn.
