I don't think AI art is copyrightable, since it is not using the original images, instead it is modifying a model that then generates art. It does very similar thing to what we do to learn, we get references, practice and learn, then our brain becomes more "fitted" or more capable of creating similar work. The dataset that trained their model is NEVER used to generate art, it is only used to train the model and the model is then used to create art. Model being some sort of neural network with bunch of neurons, weights and biases. I think what makes it scary for artists is that this technology is way faster and has good enough quality of output, that it can feel threatening, but this technology is not going away and trying to limit/slow down or ban it by making copyright arguments probably won't work.
