Since when is "opinion" legally valid as support evidence ??? Opinion is subjective not objective, neither can it be called factual etc. Thus any such part should automatically been thrown out as it does not proof nor disproof anything. It is not even jurisprudence, which might be used.
It is not always true that lack of proof of a federal case, means it does not exist. Sometimes due to the sensitive nature a case might be considered secret/top secret and as such not available despite the Freedom of Information Act.
I would say another German word is applicable. At least for the judge, namely Schadenfreude.
