Imho, the drive is liable for theaccident, BUT: That car has an emergency beaking system to avoid collisions. It should be able to avoid frontal collision to pedestrians and stationary objects regardless of the status of the autopilot, emergency lights, darkness, rain or fog. If it's easily disabled by emergency lights than the model should be recalled and the problem fixed.
Certain automation levels should be forbidden completele. Either it's a driving aid or it's a fully autonomous system within certain conditions. The partially automated craps should not even be allowed on public roads in the hands of "civilian" dtivers.
