Though I agree with a lot of this, the way these AI work it's extreemly hard for the AI to replicate a peice exactly bc it's not being trained on the data set dirrectly, it's using a discriminator nural network to try to make the art AI be more creative, the job of the discriminator AI is to tell the differance between the art of the AI and the art of the data set. Though if the moddle is overfit there can be problems with such a system, as then it can dirrectly copy art peices as the moddle can just store the data set or something extreemly similar in its structure, and this is to be avoided as it's a very undesirable result. Overfittong happens when you train an AI on to little data. So for example training a model for too long on a small set of peices for example your art, would lead to overfitting creating the problems mentioned, and even training it on a dataset of a smaller comunity of artists will likely also be overfit, as these image AIs need tons of data to not be overfit, and these AIs are very large and very hard to not overfit with any data set, so yes using a smaller data set for too long will likely overfit the AI, though on shorter periods it may not overfit but with such a small sample size it likely wouldn't take too long to do so. Though even with a data set as large as the interernet as a whole some overfitting is bound to happen, which needs to be prevented as much as possiable. If this does go to court some time, I will say what will likely be argued is if that AIs do dirrectly steal for artists or are overfit. Right now that is very likely the case with most if not all the current models out there, but if such a law suit is too slow moving the overfitting issue will likely become either more of a problem as the AIs are gettng bigger or less of a problem as we somehow sloved the overfitting problem. If it's a fixed problem I say it might convince the courts that the AI is simply taking inspration from the artists and not dirrectly coping the artists, though some laws would have to be put in place to prevent people from using the AI to copy artists artworks. If you loose such a case it would mean havok for the creative world as a whole, as these AIs would be rampont and over extending in what they do. If such a lawsuit was won it may end in a few way, saying that they can use the art but must pay the artists, opt-out or opt-in, or other such stratagies. Though I will say right now would likely be the only time where this lawsuit could be won as these AIs are good enough to have some practical uses, but not good enough to solve the overfitting problem.
