Its not OpenAIs/ChatGPTs fault, its the one who is chatting with the AI, its his fault. You can customize an AI however you want, they dont show his other transcripts or if he has turned on the memories feature, that means ChatGPT will remember everything from all conversations, you can even tell chatgpt to talk very badly when you send chatgpt a text, or you can tell chatgpt to repeat a sentence that you told chatgpt to write.
However, im 100% sure that the lawsuit will be dismissed, because chatgpt/openai got a policy in place, upon signup he agreed to the policy. You cant just signup and not agree to anything, there is also a text that says if you dont agree to it then you should refrain from using chatgpt. And not all responses might be in your favor, chatgpt is not always correct. They wont get a penny. The parents failed.
