Ai art is actually art in my opinion but art part is not the image but prompt and process so as long as they dont copy their process and prompt you cant sue for copyright(How are you gonna find that part is a question). You are not creating an image anyway you are creating prompts and processes to generate images. It isnt one click shit btw you really need to refine prompt and process a lot know which versions to choose sometimes use photoshop and rough skecth to get what you want so you can call that part an art maybe but the image part is definitely cant be copyrighted.
