current AI models have been in development for more than a decade, they started as research projects, and while they were only research projects, they were technically protected under fair use, but once those models got placed in the market as comercial products, every single copyrighted work that was previously borrowed for the development of these models becomes an infraction. it doesn't matter what the AIs are spitting out, it matters what it took to make those models do what they do, and that is, taking copyrighted works to build an application that is currently being sold as a service.
