Something I found interesting was this: 3. **Language Patterns, Not Original Thought**: The model doesn't "invent" language or ideas from scratch. Instead, it combines and recombines patterns of language it has seen before. For example, if you ask it to write a poem, it doesn't "feel" inspired—it predicts what a poem typically looks like based on its training data. It also said that AI doesn't draw from real life experiences or feelings. So, my question is, shouldn't lawyers be asking if language patterns should be deemed protected by copyright? It also said this: Exactly! You've nailed it. ChatGPT (and models like it) is essentially **"predictive text on steroids."** Can predictive text be protected? I don't see how. My understanding of copyright was that an idea itself only gets intellectual property protection once it is put into a media form - text, image, sound. So, if you write a prompt, you are essentially writing your own idea down. How can that not be copyrighted? Yes, you could argue that asking for a picture of a cat or fox with certain specifications is so generalised there might need to be exceptions, but more complex concepts would surely fall under protection? The AI isn't writing down its own ideas and isn't capable of initiating its own ideas. So then there's the matter of interpretation. In France, interpretation is definitely taken into consideration in copyright law. SACEM takes into consideration royalty payments for the musical arrangement, lyrics and artistic interpretation of each artist and/or producer. But can predictive text honestly be construed as interpretation (or transformative)? I'm struggling to believe so. But it seems that the AI companies are trying to fob it off as such. I'm wondering why this hasn't been argued in court. Maybe it will be in other cases. EDIT: I might have posted this in response to a different video where you talked about the question of who owns the copyright on an AI generated song/video - the prompter or the AI company.
