If this argument wins it will still lose. A temporary cottage industry of people copying the various styles of any number of artists will pop up who will submit their totally legal art for training AIs. Then, when the corporatist techlords have used their machines to suck these donors dry, the value of even that will drop to near-zero and you will end up with AI graphics that is effectively what we've got now.
