Argument that there should be a consent for the copyrighted material used by the machine learning (while such content is freely available for viewing in the internet) is VERY FALSE. It's like stating that author should give consent to anybody to look at the picture which he make public. Machine Learning algorithm is by no means different than a human being who sees, memorizes and then gets inspired and creates something similar. Also the Stable Diffusion you mentioned is freely available - not commercial (it can be used for commercial purposes, but then it's a problem with a particular company that does it not with the model itself).
Of course if somebody uses ML model to create very close copy of some work and then tries to profit from it then it's the plagiarism and the author should protect his/she's rights but by no means it should be done by some ridiculous consent for the ML to look at publicly available material!!!
