Data sets contains zero copyrighted information by nature.
Yes it may learn using copyright materials but only in so much as it views and makes very accurate measurements of relationships within the photos.
Once the training is complete, these algorithms are not images and can not be extracted wholesale. If you want to reproduce a peice of said art, you must prompt the ai to generate it, of which each step and iteration can be shown. There is no copy and paste of copyright work. Indeed it appears to be close enough to the original, but is only an emulation of the work.
You can call it art laundry, but if a publicly displayed photograph with added commentary can be considered transformative, which precedent has been set, iterative refinement of random digital noise surely is less of an issue.
