Well I think it's the same thing as a human saying a quote of a book or an article, or in regards of training, someone going to school and learning from publicly available books. IMHO the problem here is the machine has persistent and perfectly accurate "memory" and can reproduce it back to you without filters. Humans on the other hand, memory fades over time, you don't recall word for word and when study using a book, you or your parents actually need to buy the material.
Now ... Moving to this case, if you train a model on open and free information on the web, OpenAI or other AI company should be able to do it. But they need to provide evidence they didn't train the model using any bypass in to access content behind any safeguards (pay walls, logins, etc..).
