I’m skeptical this actually moves the needle for artists. Even if there’s a massive settlement, the major publishers will take the lion’s share to fix their own balance sheets, leaving the actual creators with a diluted pittance. Once the ink is dry, it’s over. The publishers get their payout, but the artists are still left to compete with models that have already ingested the 'pirated' logic. Whether or not Anthropic still uses those specific files today is almost irrelevant; the models have already evolved past the point of no return, and a one-time cash grab by a label doesn't fix the competitive erasure of the artist.
Take the $1.5 billion book settlement as a template: lawyers take 25% off the top, and publishers typically split the rest 50/50 (optimistic, probably worse) with the authors. For a $1.5 billion win, an individual creator might only see about $1,125 per song. Hardly a career-saving sum.
Streaming was never about artists; it was about consumer convenience. The real threat isn’t just a pirate dataset. It’s that the average consumer eventually won't care if the music is human or AI, especially for background or functional use. However valid or noble, this lawsuit is a legal skirmish, but the market shift is already a fait accompli.
Don't give artists hope that this 'fixes' all the problems - it doesn't. The old problems are still there, arguably super-charged by labels enamoured by AI themselves (money, money, money).
